Regulators are focusing increased attention on bank policies and procedures regarding spousal guaranties and spousal waivers in commercial lending transactions. At the same time, courts across the country continue to apply Reg. B in determining whether spousal guaranties are compliant with Reg. B and enforceable (often with conflicting results).
